By creating an account and using the online auction platform operated by Stuart Bond Real Estate & Auctioneer Pty Ltd, you agree to the following terms and conditions. Please read them carefully before proceeding.
1. Acceptance of Terms
By registering an account, accessing or using our auction services, you acknowledge that you have read, understood and agreed to be bound by this User Agreement. If you do not agree to these terms, you must not use the platform.
2. Registration & Account Security
- You must provide accurate and up-to-date information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- Any activity conducted under your account is your responsibility.
3. Bidding & Purchase Commitment
- Placing a bid is a legally binding commitment to purchase the item if your bid is successful.
- Once a bid is placed, it cannot be withdrawn or cancelled.
- If you win an auction, you are legally required to complete the transaction.
- Failure to fulfill your payment obligations may result in account suspension, legal action and/or additional penalties.
4. Auction Process
- All auctions are conducted by Stuart Bond Real Estate & Auctioneer Pty Ltd as the sole seller.
- Auctions will run for the specified duration and the highest valid bid at the end of the auction period will be the winning bid.
- We reserve the right to cancel or modify auctions in case of errors, disputes, or fraudulent activity.
5. Payments & Invoicing
- All payments are made off the website via invoicing and must be completed within the specified timeframe.
- Any applicable taxes, fees, or charges are the responsibility of the buyer.
6. Prohibited Activities
Users must not:
- Engage in fraudulent bidding or price manipulation.
- Attempt to avoid payment after winning an auction.
- Use the platform for illegal or deceptive activities.
7. Limitation of Liability
- Stuart Bond Real Estate & Auctioneer Pty Ltd is not responsible for any losses, damages, or disputes arising from the use of the auction platform.
- It is the responsibility of buyers to ensure compliance with all applicable laws.
8. Account Termination & Policy Violations
- We reserve the right to suspend or terminate accounts that violate these terms.
- Any attempts to manipulate auctions, avoid payment, or engage in fraudulent activity will result in immediate action.
9. Amendments to This Agreement
We may update this User Agreement at any time. Continued use of the platform after any changes constitutes acceptance of the revised terms.
